Sukha Retreats Terms and Conditions

 

  1. The contractual parties

These Terms and conditions apply to all contractual relationships between Sukha Retreats and its clients. 

 

  1. Booking trips & the contract

All persons wishing to make a booking have carefully read and understand the Terms and Conditions that follow. By making a booking with Sukha Retreats, you accept on behalf of yourself and all those named on the booking, to be bound by these Terms and Conditions. A booking is accepted and becomes definite only from the date when Sukha Retreats sends a confirmation email, and when you have completed the non refundable deposit payment.

 

  1. Services

Sukha Retreats offers yoga, art and personal development retreats in selected venues in Switzerland. 

A Retreat consists of accommodation in a specific venue and a defined set of yoga and yoga related/art/coaching classes/trainings to be held at such specific location. 

Sukha Retreats is not offering and not responsible for any other travel services related to a a retreat such as transport, transfers etc.

Sukha Retreats is entitled to replace venues or teachers/trainers for Retreats. Replaced venues need to fulfil the same standards as the originally envisaged venue and new teachers/trainers need to have similar qualifications as the originally envisaged teachers/trainers. Sukha Retreats undertakes to immediately inform clients on respective changes. As for cancellations, para. 5 hereafter applies.

 

  1. Payment Terms

For all advertised retreats, The requested non-refundable deposit* has to be paid at the time of the booking. 

 

Full payment of the Yoga Retreat is due 3 months before the retreat unless Sukha Retreats instructs the client otherwise (in some cases a second instalment is payable directly to the retreat venue and respective payment deadlines may vary). 

If the final balance is not received by the due date, then your booking cannot be guaranteed and Sukha Retreats reserves the right to cancel your booking and forfeit your deposit.

*Please note deposits made on all bookings are non-refundable and non-creditable due to the requirement to purchase non-refundable and non-transferable essentials including but not limited to; accommodation reservations etc on your behalf to secure your spot on the retreat.

 

  1. Cancellations

If a client cancels a booking 90 days or more before the Retreat, the deposit or full payment (in case it was already due) is transferrable to a new Sparkling Yoga Retreat. Such new Retreat of client’s choice must take place within 12 months from the day of cancellation. Precondition is that the new Retreat of client’s choice is still open for registration. Sparkling Yoga does not guarantee any free places in such new Retreats of client’s choice.

If you cancel more than 45 days before the retreat start date, you may request a partial refund (less a cancellation fee equal to the deposit).

All retreat payments become non-refundable less than 45 days before the retreat start date.

You may also transfer the balance to a friend if you can´t make it.

In case a client is in default (nonpayment or partial payment), Sukha Retreats is entitled to cancel the booking of such client. Any amounts received by Sukha Retreats at the time of such cancellation are non-refundable and Sparkling Yoga is not liable for any additional costs associated with such cancellation (transport cancellations, etc.). 

Any cancellation by a Client must be made in writing (via email) and be acknowledged by Balearic Retreats in writing (via email).

Sukha Retreats reserves the right to cancel any retreat for any reason, but will not cancel a retreat less than 30 days before the retreat start date except for unusual or unforeseen circumstances outside Sukha Retreats control. When a retreat is cancelled by Sukha Retreats before the agreed date of departure for any reason other than the fault of the Client, the Client can either:

Transfer their deposit to another retreat taking place within two calendar years, or receive a full refund of all monies paid under the contract as soon as possible.

Sukha Retreats is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. If the Client is offered a refund but requests an alternate retreat of a higher value than that originally booked, then the Client must pay the difference in price.

  1. Force Majeure

Sukha Retreats shall not be responsible for not fulfilling its contractual obligations to the extent that the failure to fulfill is due to events outside its control, that is, force majeure events such as a pandemic, acts of God, fire, flood, cancellation of flights or/and prohibition of sailing due to adverse weather conditions, war, acts of terrorism, riot, civil commotion, governmental actions (excluding regulatory change), labour disputes, and any similar events. In such force majeure events, no refund shall be granted and all payments will be credited in the form of a voucher valid for two years from the start date of the canceled retreat.

  1. Medical conditions & special requirements

The Client must inform Sukha Retreats on our registration form of any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect fitness to travel or practice yoga and other activities. Failure to notify us may result in the Client being refused to participate in the retreat or certain activities during the retreat at the Client’s own expense. 

Sukha Retreats will do its best to meet Client’s special requests including dietary, but such requests do not form part of the Contract and therefore Sukha Retreats is not liable for not providing these requests.

  1. Liability

The Client acknowledges that during a retreat he participates voluntarily in any and all activities arranged by the retreat hosts, and insofar as legally permissible, surrender his right to any cause of action against Sukha Retreats arising from any loss or damage to person or property that occurs during a retreat.

The Client hereby agrees to be responsible for his own welfare and accepts any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.

The Client hereby certify that is physically fit and has not been advised to not participate, by any means or in any manner, in any such activity arranged by the retreat hosts by a qualified medical professional. The Client hereby certifies that there are no health-related reasons or problems which preclude his participation in any and all activities arranged by Sukha Retreats.

The Client hereby waives, releases and discharges from and against any and all liability from his participation on the trip and  in any and all activities arranged by the retreat hosts, including but not limited to, liability arising from the negligence or fault of Sukha Retreats and/or its employees and/or its collaborators and/or its subcontractors, for his death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to the Client including the Client´s trip to and from activities arranged by the retreat hosts.

  1. Travel Insurance

By booking a Sukha Retreat, the client agrees and undertakes to take out and purchase a travel insurance. Such travel insurance has to mandatorily insure the following risks:

Cancellations of a Retreat by the client due to health issues and/or travel unability of the client or a close family member of the client

Cancellation of the retreat by Sukha Retreats under force majeure circumstances

Sickness or accidents of the client occurring during a retreat

The travel insurance has to cover the full costs of the retreat, transportation costs to and from the retreat as well as medical expenses and emergency transports. Sukha Retreats is entitled to request a client to provide evidence for the existence of a respective insurance policy. 

Optional but recommendable is the insurance of the following risks: flight delays, cancellation of the retreat by client due to loss of employment or new employment, loss of luggage, collision damage excess waiver on hired vehicles, etc. 

Please note that most insurance companies require a respective insurance to be purchased within 14 days after making a booking.

  1. Travel documents

The Client must be in possession of a valid passport required for entry, departure and travel to retreat destinations (passport must be valid 6 months past the return date), all visas, permits and certificates including vaccination certificates (if required), insurance policies, etc. are required for the whole of the journey. The Client accepts full responsibility for obtaining all such documents, visas and permits prior to the start of the retreat and is solely responsible for any adverse consequences resulting from missing or defective documentation. 

  1. Photos, video and content creation

In the course of participation in a Sukha Retreats retreat, photos or videos may be taken by participants, teachers, hosts and professional photographers. These images may be used in any Sukha Retreats promotional materials, website, all social media platforms (i.e. Instagram), etc., unless Clients specifically request to the photographer or in writing to Sukha Retreats, to not use any material their image is depicted in. Otherwise, permission is granted to Sukha Retreats to perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

  1. Data Protection 

Sukha Retreats shall only process personal data from clients for the purpose and to the extent necessary for the performance and the execution of this Agreement. Client explicitly acknowledges and consents, that to that extent and for that purpose, personal data may also be transmitted to the corresponding retreat centre or hotel hosting the retreat. Sukha Retreats shall impose these obligations on their staff members, subcontractors, subsuppliers and other engaged third parties, in particular to the corresponding retreats centres or partner hotels.

 

  1. Applicable law

Agreements between Sukha Retreats and its clients are governed by Swiss substantive law. 

The courts at the domicile of Sparkling Yoga shall be competent to decide on any dispute, controversy, or claim arising out of, or in relation to, this Agreement.

 

  1. Updating our terms of service

We reserve the right to update and/or alter these terms and conditions at anytime, and it is your responsibility to be familiar with them prior to booking with us. 

The latest terms and conditions can always be found above and will supersede any previous versions.
